 Anthony CARBINES (Ivanhoe – Leader of the House, Minister for Artificial Intelligence and the Digital Economy, Minister for Major Events, Minister for Medical Research, Minister for Racing, Minister for Economic Development) (10:39): I move:

That this house:

(1)   agrees with the request of the Legislative Council and rescinds the resolution of the house made on 1 ‍May 2019 relating to the Parliamentary Integrity Adviser, effective from 1 December 2026; and

(2)   sends a message to the Legislative Council informing them accordingly.

Further to those matters, the resolution of continuing effect adopted on 30 April 2019 established the former administrative arrangements for appointing and governing the Parliamentary Integrity Adviser. Those arrangements reflected the integrity framework operating at that time for Parliament’s institutional and legislative framework, which has since evolved. Retaining an outdated resolution risks creating uncertainty about the integrity arrangements that apply to members and the respective responsibilities of parliamentary bodies. Rescinding the resolution does not diminish the importance of integrity, ethical conduct or access to appropriate guidance for members. Integrity is not optional. Parliament’s integrity arrangements must be clear, contemporary and supported by the framework now in place, not preserved through provisions that have ceased to serve their original purpose. The government therefore supports the Procedure Committee’s recommendation to rescind the 30 April 2019 resolution, ensuring Parliament’s procedural framework remains accurate, coherent and fit for purpose.

 James NEWBURY (Brighton) (10:40): In relation to this second matter, this resolution in relation to the Parliamentary Integrity Adviser, I refer to the Council Procedure Committee’s standing orders review of this year, at page 13, which states:

The Parliamentary Integrity Adviser (PIA) position is now provided for under the Parliamentary Workplace Standards and Integrity Act 2024.

The resolution adopted by the Council on 30 April 2019 originally established the appointment of the Parliamentary Integrity Adviser. Therefore, for simplicity, the act came into effect after the original resolution. As the Leader of the House correctly said, there could be confusion in that the original resolution has been superseded by the legislation. It is appropriate that clarity exists. Therefore, in relation to this resolution, we will not be opposing the motion today.
