Kim WELLS (Rowville) (10:24): I rise today to condemn the Uniting Church in Australia Property Trust (Victoria) for its poor financial management and its disgraceful attempt to sell off the Wesley Uniting Church tennis club courts at 2 Collins Street, Box Hill, where I am a member. Following the property trust’s failure to adequately supervise noncompliant capital drawdowns from the Gore Charitable Trust, the Supreme Court determined the Uniting Church in Australia Property Trust (Victoria) was liable to restore those eroded funds. Now, to cover the cost of its own continuing governance failures and mismanagement, the Uniting Church in Australia Property Trust (Victoria) is attempting to liquidate the local tennis club by asserting the land is held by the church for general purposes. This is completely wrong. The land was gifted to the Methodist Church, now Uniting Church, over 100 years ago specifically for the purpose of a tennis club, a use explicitly acknowledged by the trustees of the Box Hill church at the time in its minutes, recording acceptance of the gift, and in their letter of thanks to the donor of the land. The nature of this gift is akin to a special trust. The Uniting Church in Australia Property Trust (Victoria) should hold this land in the spirit of the original gift, not as a general trust asset to be raided to pay for the church’s poor asset management elsewhere. The Uniting Church in Australia Property Trust (Victoria) must abandon any proposed sale of the tennis court land and respect the original intent of the gift.
