No legal assistance to defend government acts found to be illegal
The Petition of certain citizens of the State of Victoria draws to the attention of the Legislative Council that the probability that certain directions, instructions, commands and other actions given or done by Professor Brett Sutton in his capacity as Chief Health Officer, the Honourable Daniel Andrews in his capacity as Premier and the Honourable James Merlino in his capacity as Deputy Premier and Acting Premier may be ultra vires, in that they acted without legal authority.

It is also likely that these actions have caused considerable losses to businesses and individuals in Victoria. It may be that some of those businesses and individuals will want to recover these losses through court action.

It would be wrong for the people of Victoria to pay the legal defence costs of Prof. Sutton, Mr Andrews and Mr Merlino when the subject actions were ultra vires.

As a matter of good public policy, we should encourage personal responsibility of public servants where they act beyond their given authority. Public servants should have to pay their own legal bills where they have stepped outside their authority.
The petitioners therefore request that the Legislative Council call on the Government to acknowledge the injustice of spending taxpayer funds to defend ultra vires actions of public servants and take immediate steps to withdraw state funds supporting the legal defence of actions where the causative acts are shown to be ultra vires.
