The petition of certain citizens of the State of Victoria draws to the attention of the Legislative Council that the Statewide Treaty Act 2025 (The Act) creates different rights and privileges based solely on a person’s ancestry, undermining the fundamental principle of equality before the law. The Act divides Victorians by entrenching separate legal and political pathways for people based on heritage, instead of promoting unity. It compels members of Parliament to endorse a single, Government-approved version of history through mandatory 'treaty compatibility' statements. The Act was developed without genuine consultation across all Indigenous communities, leading to division and disputes even over the use of language and cultural terms. It establishes costly, largely unaccountable bureaucratic structures that will further burden taxpayers during a period of significant financial stress in Victoria. The Act lacks clarity, transparency, and broad public mandate, especially given the complexities and long-term implications of treaty frameworks.
The petitioners therefore request that the Legislative Council call on the Government to immediately repeal the Statewide Treaty Act 2025 and ensure that any future law respecting the rights and aspirations of Indigenous people upholds one citizenship, one legal system, and equal rights for all Victorians, focuses on practical outcomes for Indigenous peoples, ensures that the needs of individuals are prioritised regardless of ancestry, and seeks to unite, not divide, the State.
