Petition Implement specialised framework for two-lot subdivisions disputes

The petition of certain citizens of the State of Victoria draws to the attention of the Legislative Council disputes in two-lot subdivisions which are often difficult, costly and time-consuming to resolve. With only two owners sharing common property, there is no committee majority to break deadlocks or make decisions when disagreements arise. Disputes about parking, access, maintenance, surveillance and common property can continue for years through repeated VCAT proceedings, causing significant financial and personal stress. Legal costs frequently exceed the value of the issues in dispute, while delays can affect owners’ ability to peacefully enjoy their homes. The current system largely treats two-lot subdivisions the same as larger owners' corporations, despite their unique challenges. Reforms are needed to provide faster, fairer and more practical dispute resolution, reduce unnecessary litigation and ensure that owners in small subdivisions have access to effective mechanisms for resolving conflict.

The petitioners therefore request that the Legislative Council call on the Government to implement specialised framework for fair, affordable and timely dispute resolution for owners in two-lot subdivisions, including mandatory mediation, expedited hearings, stronger powers for independent administrators, regulation of CCTV and common property use, and cost consequences for unreasonable conduct.
