Petition Structurally destructive flora in residential areas

Issue:

This petition of residents in Victoria draws to the attention of the Legislative Assembly the severe property and infrastructure damage caused by the unregulated planting of highly invasive, out-of-control, and structurally destructive flora in residential areas. Both exotic plant species (such as running and clumping bamboo, fishbone ferns, and Desert Ash trees) and certain aggressive native plant species can cause extensive structural displacement—breaking stormwater pipes, cracking house foundations, and destroying boundary fences. Current biosecurity and planning laws fail to protect suburban homeowners from these hazards, lack ongoing enforcement mechanisms, and do not hold owners legally or financially accountable when they plant high-risk species directly adjacent to boundaries without disclosing known structural risks.

Action:

The petitioners therefore request that the Legislative Assembly amends Victoria’s environmental, building, and biosecurity laws to introduce a comprehensive containment, enforcement, and incentive framework for destructive residential flora, requiring: restricting high-risk exotic and native species, prohibiting unpermitted deliveries, and mandating landlord consent; complete exemption for these species if grown exclusively within pots or sealed above-ground planters; prior municipal permit approval, mandatory certified root barriers, and reproductive containment protocols; risk-based compliance audits and council inspections with escalating monetary fines; mandatory neighbour notification if plants encroach, with original owners funding containment on the neighbour’s side; strict civil penalties for the silent negligence of known structural risks; a government-funded suburban native plant replacement program rewarding cooperative property owners with free native flora alternatives.
