Appendix 5 – Premier’s Certificates

Premier’s Certificates issued in 1997

SR 6 – EDUCATION (MAINTENANCE ALLOWANCE) REGULATIONS 1997
These Regulations were for six month’s duration and prescribed the manner of payment of the education maintenance allowance for school children.

SR 15 – TOBACCO (AUSTRALIAN GRAND PRIX) REGULATIONS 1997
These permit tobacco advertising at the 1997 Australian Grand Prix at Albert Park and were operative for only a short while.

SR 67 – VICTORIA WATER SUPPLY AND SEWERAGE PLUMBING (EXTENSION) REGULATIONS 1997
These Regulations prolong the life by 12 months of the 1994 Principal Regulations that originally had a 3-year life only.

A Premier’s certificate was needed because the 1994 Regulations did not expire by virtue of section 5 of the Subordinate Legislation Act 1994 but because of its own internal provision. Accordingly, the extension of operation provisions found in section 5 of the Subordinate Legislation Act could not be used. As there was insufficient time to prepare a RIS (which involved reviewing hundreds of plumbing standards) and as it was important that regulation of the plumbing industry remained, a Premier’s certificate was the only alternative.

A technical point of interest for Members is that SR 67/97 not only substitutes a fresh expiry date in the 1994 Regulations, but goes on to set the same expiry date for itself - cleaning up the statute books along the way

SR 83 – FISHERIES (PORT PHILLIP BAY - TEMPORARY CLOSURE OF AREA TO FISHING) REGULATIONS
These Regulations are for 6 months and temporarily close an area in Port Phillip Bay of about 3 kilometres square to all fishing and boating activity during the sporing season of the large species of marine kelp, Undaria.

SR 98 – TOBACCO (AUSTRALIAN MOTORCYCLE GRAND PRIX) REGULATIONS 1997
These Regulations permit tobacco advertising for the conduct of the Australian Motorcycle Grand Prix at Phillip Island in October 1997. They were made on 25 September 1997 and were revoked on 1 November 1998.

SR 107 – FREEDOM OF INFORMATION (EXEMPT OFFICES)(INTERIM) REGULATIONS 1997
These Regulations prescribe offices which are not to be taken as a "prescribed authority" for the purposes of the Freedom of Information Act 1982. The Regulations were of 6 month’s duration.

SR 156 – WILDLIFE (WHALES) REGULATIONS 1997
These Regulations are of 12 month’s duration and were made to protect whales over the summer season of 1997-1998. The Wildlife Act 1975 had only recently been amended to allow the making of the Regulations and time did not permit conduct of the RIS process.
