Appendix 1: Privacy Code of Conduct for Members
of the Victorian Parliament
This voluntary Code applies to the handling of personal
information by participating Members of the Victorian Parliament (Members).
It does not in any way diminish Parliamentary Privilege or curtail the
rights and responsibilities of Members. Personal health information must
be handled in accordance with the provisions of the Health Records
Act 2001.
personal information means information or
an opinion (including information or an opinion forming part of a database),
that is recorded in any form and whether true or not, about an individual
whose identity is apparent, or can reasonably be ascertained, from the
information or opinion.
individual means a natural living person.
Collection
Members will collect personal information which is necessary
for their functions by lawful and fair means and not in an unreasonably
intrusive way.
Where Members obtain prejudicial information about individuals
from third parties, they will take reasonable steps to verify it.
Use and Disclosure
Members will only use or disclose personal information as
necessary for their functions, taking into account the sensitivity of
the information.
Data Quality
Members will take reasonable steps to ensure that the personal
information they collect, use or disclose is accurate, complete and up
to date.
Data Security
Members will take reasonable
steps to protect the personal information they hold from misuse and loss
and from unauthorised access, modification or disclosure.
Members will take reasonable steps to destroy or permanently
de-identify personal information if it is no longer needed for any purpose.
Openness
Members will make this Code of Conduct publicly available.
Access and Correction
To the maximum extent reasonable, Members will provide an
individual on request with access to information they hold about that
person.
Where providing access is inappropriate, Members will provide
reasons.
Accountability
Members will be accountable for compliance with this Code
to the Presiding Officer of the relevant House.
