Review of the Carriers and Innkeepers Act 1958, May 1998Chairs Foreword[Return to Table of Contents]The Redundant Legislation Subcommittee is pleased to present its Report on the Carriers and Innkeepers Act 1958. The Subcommittee reviewed the Act pursuant to a request from the Minister for Fair Trading to consider the Act under the Subcommittees reference to review redundant and unclear legislation. The Report represents several years of hard work by the Subcommittee and its staff. Extensive research on the complex legal issues arising from the Act was carried out, and lengthy consultations with groups and individuals affected by the legislation took place. It became clear to the Subcommittee during the review that, while carriers had no objections the repeal of the provisions of the Act affecting them, "innkeepers" opposed any changes to the Act. The Subcommittee, in making its recommendations for substantial changes to this area of the law, considers that it has struck an appropriate balance between the interests of those running accommodation establishments and the general public who stay in those establishments.
