Casting Votes

What is a Casting Vote?

Summary

The Speaker has power to give a casting vote, in some circumstances.

Background

What is a casting vote?  In the Assembly, all questions are decided by a majority of members present.  If the votes are equal after a division, the Speaker  has a casting vote to decide the question:

Section 40 of the Constitution Act 1975 provides for the Speaker to have a casting vote.

·

Standing Order 167 confirms the Speaker’s power to have a casting vote, and requires that if the Speaker gives reasons for the casting vote, those reasons are recorded in the Votes and Proceedings.

·

The only time the Speaker can vote is when the votes are equal.
